Terms and Conditions of Service

  1. Introduction

These terms and conditions ("Agreement") govern the provision of window cleaning, bin cleaning, gutter cleaning and pressure washing services and domestic appliance repairs ("Services") by Francis Incorporated ("Company") to its customers ("Customer"). By engaging our Services, the Customer agrees to be bound by the terms and conditions outlined herein.

  1. Service Agreement

2.1 Scope of Services: The Company shall perform bin cleaning, window cleaning, gutter cleaning, pressure washing services and domestic appliance repairs as agreed upon between the Customer and the Company.

2.2 Service Schedule: The Company shall strive to adhere to the agreed service schedule. However, occasional delays or rescheduling may occur due to unforeseen circumstances, such as inclement weather or equipment malfunctions.

  1. Customer Responsibilities

3.1 Access and Safety: The Customer shall ensure that the Company has safe and unimpeded access to bins, windows and all other cleaning areas. The bins must be within arms reach of the pavement. The Customer shall also take reasonable steps to ensure the safety of the Company's personnel during the provision of Services.

3.2 Bin Preparation: The Customer shall ensure that the wheelie bins are emptied, free of excessive waste, and accessible for cleaning at the scheduled service day. 

  1. Pricing and Payment

4.1 Service Fees: The Customer agrees to pay the fees for the Services as outlined in the Company's current pricing schedule, which may be subject to change. All fees are exclusive of any applicable taxes.

4.2 Payment Terms: Payment for Services shall be made in advance, according to the agreed frequency (e.g. monthly, quarterly). The Customer shall make payment via the accepted payment methods provided by the Company.

4.3 Late Payments: In the event of late payment, the Company reserves the right to suspend or terminate Services until all outstanding fees are settled. Late payments may also incur additional charges, as specified by the Company.

  1. Limitations of Liability

5.1 Service Limitations: The Company shall exercise reasonable care and skill in providing the Services. However, the Company does not guarantee the removal of all stains, odours, or debris. The Customer acknowledges that the efficacy of the cleaning process may vary depending on factors beyond the Company's control. As a result of our advanced water purification system, our window cleaning process allows for natural drying, leaving minimal to no streaks. Hence, we do not undertake the additional step of manually drying the windows.

5.2 Indirect Damages: The Company shall not be held liable for any indirect, consequential, or incidental damages arising from the provision of Services, including but not limited to loss of profits, loss of data, or damage to property.

  1. Termination

6.1 Termination by Customer: The Customer may terminate the Services by providing written notice to the Company, subject to any applicable contractual obligations or minimum term agreements. The minimum term for our 4 weekly cleaning service is 3 months. In adherence to our cancellation policy, should you choose to cancel our services with immediate effect, please be advised that you will be charged for the remaining service duration, no further services will be provided and no refunds will be issued.

6.2 Termination by Company: The Company reserves the right to terminate the Services immediately if the Customer breaches any material term of this Agreement or engages in misconduct or behaviour that may harm the Company's reputation or personnel. In adherence to our cancellation policy, should your membership be cancelled with immediate effect, please be advised that you will be charged for the remaining service duration, no further services will be provided and no refunds will be issued. 

  1. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. Miscellaneous

8.1 Entire Agreement: This Agreement constitutes the entire understanding between the Customer and the Company concerning the subject matter herein and supersedes any prior agreements or understandings, whether written or oral.

8.2 Amendments: Any amendments or modifications to this Agreement must be made in writing and agreed upon by both parties.

8.3 Severability: If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

By engaging our Services, the Customer acknowledges having read, understood, and agreed to abide by these terms and conditions.
